General conditions of sale

Upstream, it is important for us to specify that the works marketed on the site www.moga.art can be sensitive to the environment. In order to allow you to enjoy our works as much as possible, we advise you to expose them as little as possible to the sun (or at least directly), not to place them above a heater or air conditioning and not to expose them in rooms that are too humid.

Scope of application

These General Terms and Conditions constitute a legal agreement between you and MoGA SAS (hereinafter referred to as "MoGA") governing the commercial relationship in the context of the acquisition of a work on the website www.moga.art. The following General Terms and Conditions of Sale are exclusively applicable in their version in force at the time of the order. MoGA does not recognize any divergent conditions of the customer, unless MoGA has expressly recognized their validity in writing.

Contractualization

The works presented in the online shop do not represent a legally binding offer, but a non-contractual online catalogue. Before completing the order and making the payment, a summary view will be displayed so that you can check all the elements (products, addresses, delivery information, etc.). Once the order has been placed, you agree to pay MoGA for the products in your shopping cart.

Upon receipt of payment, we automatically validate your order and prepare the shipping process. You will receive an order confirmation by email immediately after sending the order, which includes the details of your order.

MoGA recommends for your safety to print the order data and the General Conditions of Sale in force at the time of the order. All communications are in French.

Pricing and prices

All prices indicated on the website www.moga.art are final and include VAT (value added tax). Unless otherwise stated, shipping costs are included in the order. You can make your payment by card via our secure partner Payplug.

Withdrawal

As our works are printed and pulled to measure and on demand, the right of withdrawal does not apply. A return without additional costs (excluding shipping costs payable by the customer) is nevertheless possible within 14 days.

Delivery

The delivery of the works is made to the address indicated during your order confirmation. Unless otherwise indicated, our works are sent via our partner Chronopost. The deadlines indicated during your order are given for purely indicative purposes.

Certificate of Authenticity

Along with receiving the work, you will also receive (with the same order or in parallel with it) a certificate of authenticity signed (digitally) by the author of the work, indicating in particular the information of the work and the number of the edition that you have ordered.

Retention of title

The works remain the property of MoGA until full and final payment.

Assignment of rights

With the purchase of a reprint, you only acquire ownership of the reprint. No other rights of use are granted. Any reproduction, distribution, rental, making available to the public or other analog or digital exploitation is prohibited.

Applicable law

These General Conditions of Sale are subject to French law.
